Monkey Business Terms of Service
These Terms of Service ("Terms") govern your use of the Monkey Business mobile game and any related online features and services (together, the "Service"), provided by Fox Innovations LLC ("we," "us," "our"). By downloading or playing Monkey Business, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can play
Monkey Business is intended for players aged 13 and older. If you are under the age of legal majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
2. License to play
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and play Monkey Business on a mobile device you own or control, for your own entertainment and non-commercial use. Your use is also subject to the usage rules of the store you downloaded the Game from (Apple's App Store terms or Google Play's terms).
3. Guest play and optional accounts
You may play as a guest using an anonymous Unity player identifier. You may also choose to link a Unity Player Account to protect supported progress across devices. You are responsible for keeping linked sign-in credentials secure and for activity under that account.
You may request deletion through the in-game Player Account screen or our Account and Data Deletion page. Account deletion is permanent and may remove cloud progress, leaderboard identity, and other data associated with the account, except records we must retain by law.
4. Virtual goods and currency
The Game includes virtual items such as bananas (the in-game currency), lives, power-ups, and other content ("Virtual Items"), whether earned in play or bought as in-app purchases. You acknowledge and agree that:
- Virtual Items have no real-world value. They are not money or property and cannot be redeemed, exchanged, sold, or transferred for real money or anything of value outside the Game.
- Virtual Items are licensed, not sold. You receive a limited license to use them inside the Game only.
- We may adjust, rebalance, convert, or discontinue Virtual Items (including banana balances, earn rates, and prices) at any time as part of operating and balancing the Game.
- Virtual Items obtained through cheating, exploits, fraud, or unauthorized purchases may be removed.
5. Purchases and refunds
In-app purchases are processed entirely by Apple's App Store or Google Play, and payment is governed by their terms. We do not receive or store your payment details.
- Consumable purchases (such as banana packs and extra lives) are granted once after a successful purchase and are then used up in play. Consumables cannot be restored.
- Refunds are handled by Apple or Google under their refund policies. Please request refunds directly through the App Store or Google Play. Except where required by law, all purchases are final.
If a completed purchase does not appear in the Game, see our Support page before requesting a refund. Most missing purchases are recovered automatically on the next app start.
6. Advertising
The Game is supported in part by advertising, including optional rewarded ads that you choose to watch in exchange for in-game rewards, and occasional interstitial ads. Rewarded ads only grant a reward when the ad provider confirms the ad was completed. Advertisers and ad networks are responsible for their own content, and your privacy choices for ads are described in our Privacy Policy.
Optional social sharing challenges
The Game may offer virtual rewards when you use its Share Challenge page and confirm that you completed a platform task. Social platforms do not provide us with reliable independent confirmation that your post was published. You agree to claim a share reward only after completing the task shown. Each platform reward is limited to one claim per player save. We may withhold or remove rewards obtained through automation, tampering, false claims, or other abuse. You are responsible for the content you choose to publish and for following each social platform's rules.
7. Leaderboards and fair play
Your public player tag must be appropriate for a general audience and comply with the Community Rules. The Game provides ten bundled avatars and does not upload profile photos. You may not use a tag that is illegal, hateful, sexually explicit, threatening, harassing, impersonating, privacy-invasive, or rights-infringing. We may release or replace a tag, remove leaderboard content, restrict online features, or take other reasonable action after a report or violation. Report inappropriate leaderboard content through the in-game report action or to support@foxinnovate.com.
Leaderboards are meant to reflect real, skill-based play. You agree not to:
- Cheat, use bots, scripts, automation, exploits, or modified versions of the Game.
- Manipulate scores, rewards, currency, purchases, or leaderboard rankings.
- Interfere with the Service, other players, or the security of the Game.
- Reverse-engineer, decompile, or extract the source code of the Game, except where the law permits it despite this restriction.
- Use the Service to violate any law or the rights of any third party.
We may remove or reset scores, balances, or progress that we reasonably believe are fraudulent, cheated, or produced by exploits, and we may restrict access to leaderboards or the Service for violations of this section.
8. Ownership
The Game, including its code, art, audio, characters, names, and all related intellectual property, is owned by Fox Innovations LLC or its licensors. Except for the license in Section 2, no rights are granted to you. "Monkey Business" and associated logos may not be used without our permission.
9. Changes to the Service
Monkey Business is a live game. We may update, change, suspend, or discontinue the Service or any part of it (including features, Virtual Items, events, leaderboards, and online services) at any time, with or without notice. Some features require an internet connection and may be unavailable from time to time.
10. Termination
You can stop using the Service at any time by uninstalling the Game. We may suspend or terminate your access to the Service (including online features and leaderboards) if you violate these Terms, if we discontinue the Service, or where reasonably necessary to protect the Service or other players. Upon termination, your license under Section 2 ends. Sections 4, 8, 11, 12, and 13 survive termination. If we terminate your access without cause, your only remedy is discontinuing use of the Service; Virtual Items are not refundable except where required by law or by Apple or Google policy.
11. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that progress, scores, or Virtual Items will never be lost. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, Fox Innovations LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, progress, Virtual Items, profits, or revenues, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service is limited to the greater of (a) the amount you paid us through the Service in the twelve months preceding the claim and (b) fifty US dollars (US$50). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
13. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, and the courts located in Florida will have jurisdiction over disputes that are not required to be resolved elsewhere by applicable law. If you are a consumer in a jurisdiction whose law grants you mandatory protections or a mandatory forum, those protections are not affected. The store terms of Apple or Google apply in addition to these Terms, and Apple and Google are third-party beneficiaries of these Terms to the extent their policies require.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to updated Terms, stop using the Service.
